Non-Immigrant Visa Options

Non-immigrant visas cater to temporary stays for purposes like employment, business, leisure, study, or transit. Of the 8 available options, the 9(g) work visa is commonly sought by foreign nationals looking for long-term employment in the Philippines.
In addition to the 9(g) visa, foreign individuals often apply for the 9(A) Temporary Visitor’s Visa. This visa is suitable for those seeking a brief stay in the Philippines for tourism, business, or medical reasons. Other visas within this category encompass student, transit, diplomatic, investor, and seaman’s visas.

General Requirements for Non-Immigrant Visas

Prior to applying for a visa, foreign nationals must gather the necessary documentation. Here are the prerequisites for a 9(g) visa application:

1. Checklist with complete documentary required; and
2. Completed aforementioned AEP and 9(g) Work Visa Application Form; and
3. Additional information on the applicant’s children (if applicable) and
4. Certified True Copy of Company Registration such as Business Permit and SEC Registration
5. Notarized Letter Requests
6. Notarized certification of the number of foreigners and Filipino employees and
7. Any additional documents deemed necessary to support the applicant’s employment

Immigrant Visa Options

Immigrant visas are for foreign individuals who seek permanent residence in the Philippines. There are two types of immigrant visas offered to foreign nationals, those are quota immigrant visas and non-quota immigrant visas.

Quota immigrant visas are designated for foreign nationals from countries with diplomatic relations with the Philippines, reciprocating immigration privileges granted to Filipino citizens. The Bureau of Immigration in the country issues a maximum of 50 quota visas annually.

Non-quota visas are tailored for foreigners married to Filipino citizens and former Filipino citizens looking to reacquire citizenship in the Philippines. The 13(A) Marriage Visa, a common non-quota visa, is granted to foreign spouses of Filipino citizens with marriages legally acknowledged under Philippine laws.

The 13(g) Visa, a type of non-quota visa, is designated for previously natural-born citizens of the Philippines who have been naturalized citizens of a foreign country and intends to return to the Philippines for permanent residence.

Special Visa Options

Special non-immigrant visas are typically provided to foreign individuals employed by Philippine-registered companies. The most prevalent types of this visa include:

• PEZA Visa. These visas are granted to individuals employed by companies registered with the Philippine Economic Zone Authority (PEZA), the Board of Investments (BOI), or oil drilling companies.
• ROHQ/RHQ Visa. This visa category is for foreign executives assigned to fulfill responsibilities at the regional operating branch in the Philippines. It typically has a maximum validity of three years.

On the other hand, special immigrant visas are extended to foreign individuals looking to establish permanent residency in the Philippines for reasons related to work, investment, or retirement. At present, there are three types of special immigrant visas accessible to foreigners, which includes:

• Special Investor’s Resident Visa (SIRV). This visa is issued to foreigners who invest a minimum of US$75,000 in either new or existing companies in the Philippines. The company must operate within specific industries or be publicly listed.
• Special Visa for Employment Generation (SVEG). The SVEG is granted to foreign individuals who have substantial Investment and commit to employing a minimum of 10 Filipinos in a legal and sustainable enterprise, trade, or industry.
• Special Resident Retiree’s Visa (SRRV). The SRRV is provided to foreign individuals aged 50 and above who can make an initial deposit starting as low as US$1,500.
